  2. Durable power of attorney. A durable power of attorney is designed to stay in effect if the principal becomes incapacitated for some reason. The current power of attorney will stay in effect in order to minimize disruptions in these situations. In these cases, the principal can also specify that a power of attorney will not go into effect until a doctor certifies them as mentally incompetent or incapacitated.
