Power of Attorney

Phoenix Power of Attorney Litigator

A power of attorney (POA) is a powerful document that allows one person to appoint another person or organization to manage their financial affairs, property, or medical affairs if they are unable to do so. However, these documents must be crafted carefully, and not all POAs are created equally.

At Yen Pilch Robaina & Kresin PLC, our team is here to help when you need a Phoenix power of attorney lawyer to help you through these situations. We understand the different types of POAs, and we will ensure that we act in your best interests when crafting any document handing over control of your affairs.

Understanding a Power of Attorney

In order to understand a power of attorney, we want to discuss the four basic types you need to be aware of:

  1. General power of attorney. A general power of attorney gives another individual or organization broad powers to act on behalf of the principal. These powers can include helping handle financial and business transactions, operating business interests, employing professional help, finding life insurance, settling claims, and more.
  2. Special power of attorney. With this type of power of attorney, the principal is allowed to specify which powers another person is able to exercise. This type of power of attorney is used when a person is unable to deal with certain aspects of their life because of health reasons or other commitments they may have. For example, if a person is traveling overseas for extended periods of time, they may need a special power of attorney to help facilitate the sale of their property.
  1. Healthcare power of attorney. A health care power of attorney can grant a person the authority to make medical decisions on your behalf if you become mentally incompetent, unconscious, or otherwise unable to make decisions on your own. This is not the same thing as a living will.
  2. Durable power of attorney. A durable power of attorney is designed to stay in effect if the principal becomes incapacitated for some reason. The current power of attorney will stay in effect in order to minimize disruptions in these situations. In these cases, the principal can also specify that a power of attorney will not go into effect until a doctor certifies them as mentally incompetent or incapacitated.

The dedicated team at Yen Pilch Robaina & Kresin PLC is ready to provide you and your family with compassionate assistance when establishing the power of attorney plan that meets your needs. We understand the laws in Arizona concerning POAs, and we are ready to get to work on your behalf immediately.

A Phoenix power of attorney lawyer will understand the specifics of every type of POA and will be able to make suggestions about which one will best meet the needs of the situation.
